Trouble is in Australia that we have no exemplary damages except for intentional torts so even where there is gross negligence such cases are a dead duck. The non economic loss is negligible and there are few out of pocket expenses as the Fed government pays most medical bills. Do your insurers indemnify their insureds for punitive damages? Those damages must simply cause companies to go bankrupt if there is no cover. How much do your plaintiffs ultimately recover as they just go into the pool with all the other creditors?
