Negligence As It Relates To Car Accidents

Many people hear the word “negligence” and are not sure what it really means, particularly in the case of a car accident. Generally speaking, negligence is a legal theory that means that someone acted carelessly, and the person’s careless act resulted in someone else’s injury. People can be negligent by either doing something that shouldn’t have been done or by not doing something that should have been done.

If you or a loved one has been injured in a car or a truck accident and you believe that the other driver negligently caused your injuries, you might consider filing a claim against the other driver. However, you must meet certain criteria to file a negligence claim, and an experienced attorney can help you determine whether or not you have a viable case. The elements that must be proven are:

What Happens After The Car Crash – Personal Injury Lawyers

As you look through the car accident information materials after a motor vehicle accident, you might wonder how they apply to you. Your first question could be, “Do I have a case?” The best approach to this concern is to become better informed about how your particular accident fits into the big picture.car accident lawyers

You know that the accident resulted in emotional and physical pain. Maybe you were injured, or maybe someone you cared about died in the crash. Is there reason to think you could receive damages to pay you for the harm that was done? More on this website @ http://no1-lawyer.com

What Happened?

The facts of your case will determine if there was an injury or death you could be compensated for. It is important to conduct a thorough investigation. This will involve finding out all the facts of the accident.

Sources can include accident reports created by police and car insurance companies, accounts from eyewitnesses and your own recollections about your car accident. Professional investigators can be consulted to review the accident scene and the damage to vehicles, to reconstruct the details of a collision.

Emergency room records and other medical records are essential in determining the extent of injuries and can help an investigator identify the cause of the injuries. If someone was killed, coroner’s reports will detail the cause of death, which is vital evidence in a wrongful death case.

Did A Negligent Driver Cause The Crash?

Every driver has a duty to everyone else on or near the road to be reasonably careful when operating a motor vehicle. If the facts show that a driver failed to be careful, that driver’s behavior was negligent.

For example, suppose a driver wasn’t paying attention because he or she was reaching for a sandwich and looked away from the road. If the driver was distracted and did not yield the right of way to you at an intersection, the driver failed to be reasonably careful. If the driver’s car T-boned your vehicle and you were injured, a jury would likely find that driver’s negligence caused your injury and the expenses that resulted.Truck accident attorneys

A negligent driver is liable for the cost of injuries caused by the negligence, so you could have a good case to take to court.

Victimized In An Accident – Get An Experienced Attorney

WHY IS EXPERIENCE IMPORTANT?

There are many pitfalls for lawyers who are inexperienced with accidents involving TRUCKS, TRACTOR-TRAILERS, and COMMERCIAL VEHICLES. These “pitfalls” do not exist in the “typical, everyday” motor vehicle accident case. By way of example, accidents involving TRUCKS, TRACTOR-TRAILERS, and COMMERCIAL VEHICLES are almost always governed by the Federal Motor Carrier Safety Regulations, which are complex federal laws governing every aspect of the commercial driver’s use of his vehicle. Truck accident attorneys
One of these laws restricts the total number of hours a driver can be on the road during a seven-day period. Studies have shown that the vast majority of accidents involving TRUCKS, TRACTOR-TRAILERS, and COMMERCIAL VEHICLES are caused by “driver fatigue.” Therefore, all commercial over-the-road drivers are required to keep a Driver’s Record of Duty Status, which is a logbook recording all of the driver’s movements each day down to the minute. These records can be the most critical piece of evidence in a case involving a TRUCK, TRACTOR-TRAILER, or COMMERCIAL VEHICLE and it is not uncommon for a commercial truck driver to “FALSIFY” his logbook so he can drive beyond the maximum number of hours allowed by law. More information @ Truck Accident Attorneys San Antonio

PITFALLS FOR THE INEXPERIENCED

A pitfall an inexperienced attorney may fall into when attempting to obtain these log books occurs if the lawyer waits “too long” to file your lawsuit. Typically, in a “normal” personal injury car-wreck case, the injured party has one 2 years from the date of the accident within which to file their lawsuit. The same time limit will usually apply to accidents involving TRUCKS, TRACTOR-TRAILERS, and COMMERCIAL VEHICLES, however, rarely should an attorney wait that long to file your lawsuit. The reason comes from a review of the Federal Motor Carrier Safety Regulations, which specifically allow trucking companies to DESTROY all of their records after six (6) months, including all of their driver’s logbooks. Therefore, if an inexperienced attorney waits more than six months after the date of your accident to file your lawsuit, it is almost guaranteed that the trucking company will have destroyed the logbooks relevant to your case by the time your attorney requests copies of them. When trucking companies destroy these logbooks, there is very little a court can or will do to the trucking company since the trucking company will always claim they are simply following federal law to the letter. If the driver’s logbooks have been falsified, you can bet the trucking company will destroy them on the very day the six month time period runs out, thereby preventing you from ever knowing the truth about the real cause of the accident.

The “logbook loophole” is only one example of the many possible pitfalls and loopholes that exist in these cases for the inexperienced lawyer.

If you or a loved one has been injured, or you have lost a loved one in an accident involving a TRUCK, TRACTOR-TRAILER, or COMMERCIAL VEHICLE, do not hesitate to contact our office. We will be happy to answer your questions and meet with you at NO CHARGE to discuss your case.
