Six employees recovering after chemical exposure

Six employees of the Landfill are recovering after being exposed to a pesticide being sprayed on a nearby orange orchard. Firefighters along with Environmental Health and the Highway Patrol responded to the landfill just before noon Saturday.

Fire officials say the spraying operation at the orchard had to be shut down while the employees that were exposed to the insecticide known as NUFOS were found. Six landfill employees with inhalation and skin exposure were evaluated. Some employees were treated for nausea and breathing difficulties. Others experienced minor vomiting and breathing difficulties.

All of the employees were decontaminated with soap and water inside two separate guard shacks at the landfill. Four female employees were taken to the hospital as a precaution. Two others were treated at the scene. There were no reports of injuries to firefighters.

The general contractor on any work site has a nondelegable duty to enforce all safety regulations for all employees on site, not just the employees of the general contractor. This duty runs from all upper tier subcontractors to all lower tier subcontractors which the sub may hire on the job site. This nondelegable duty to enforce all safety regulations on all work sites applies not just to general contractors but to owners, developers and those with supervisory authority in the work place. All employers are obligated to provide a reasonably safe work place for its employees and those with whom it contracts with to furnish labor and materials for it.

If a worker is injured in the work place, he may file a worker’s compensation claim. An injured worker not only has a right to file a worker’s compensation, e.g. a Labor and Industries claim, but may also have a viable “third party claim” to recover damages against the contractor, subcontractor or any other independent trade which was negligent. This would be a claim against any negligent company or an employee of another company on a job site which caused the worker’s injury. The injured worker may file a third party claim against the employer of the negligent worker and arguably claim that the employer or its employee failed to enforce or follow certain OSHA regulations.

Man Suing for Construction Injuries

A  man says he lost wages after he stepped on a piece of sprinkler pipe while working as a carpenter at a construction site. He is seeking a judgment of more than $150,000, plus costs.

“While working at said construction site, the man, while walking toward his tools after pouring concrete stepped on a piece of sprinkler pipe thereby causing him to suffer severe bodily injury,” the suit states.

Because of the incident, he was made sick, sore, lame, disordered and disabled, suffered a back injury and incurred medical costs, the complaint says. In addition, he says he suffered disability, experienced pain and suffering and lost wages.

The company in control of the construction site, failed to maintain a clean and safe workplace, failed to clean up construction debris, failed to warn the man of a dangerous condition and failed to hire careful contractors who would keep a safe workplace, the complaint says.

Children’s Hooded Windbreakers Recalled

A clothing manufacturer just issued a recall for one of their windbreaker jackets, the U.S. Consumer Product Safety Commission (CPSC) just announced. The CPSC reminds consumers that it is illegal to resell or to attempt to resell a recalled consumer product.

The recalled windbreakers contain dangerous drawstrings which pose strangulation and entrapment hazards to young children.

The CPSC issued guidelines to help prevent children from strangling or getting entangled on the neck and waist drawstrings in upper garments, such as jackets and sweatshirts. Later, the CPSC’s Office of Compliance issued an announcement that such outerwear with drawstrings at the hood or neck would be regarded as both defective and a substantial risk of injury to young children.

Unfortunately, the CPSC guidelines are routinely ignored by the clothing industry, and that attitude has had deadly consequences for some children. The CPSC received reports of 22 deaths and 48 non-fatal entanglement incidents involving drawstrings on children’s clothing.

To date, no incidents or injuries have been reported in connection with this Product Recall.

The Defective Product is a children’s windbreaker jacket with drawstrings in the hoods. The jackets were sold in red, blue, and multi-colored (purple, blue, yellow, green, light blue) in sizes 12 months to 4T.

The Recalled Windbreakers, which were manufactured in China, were sold in department stores for about $80.00.

The CPSC is advising consumers to immediately remove the drawstrings from the jackets to eliminate the hazard.
