Man Suing for Construction Injuries

A  man says he lost wages after he stepped on a piece of sprinkler pipe while working as a carpenter at a construction site. He is seeking a judgment of more than $150,000, plus costs.

“While working at said construction site, the man, while walking toward his tools after pouring concrete stepped on a piece of sprinkler pipe thereby causing him to suffer severe bodily injury,” the suit states.

Because of the incident, he was made sick, sore, lame, disordered and disabled, suffered a back injury and incurred medical costs, the complaint says. In addition, he says he suffered disability, experienced pain and suffering and lost wages.

The company in control of the construction site, failed to maintain a clean and safe workplace, failed to clean up construction debris, failed to warn the man of a dangerous condition and failed to hire careful contractors who would keep a safe workplace, the complaint says.

Children’s Hooded Windbreakers Recalled

A clothing manufacturer just issued a recall for one of their windbreaker jackets, the U.S. Consumer Product Safety Commission (CPSC) just announced. The CPSC reminds consumers that it is illegal to resell or to attempt to resell a recalled consumer product.

The recalled windbreakers contain dangerous drawstrings which pose strangulation and entrapment hazards to young children.

The CPSC issued guidelines to help prevent children from strangling or getting entangled on the neck and waist drawstrings in upper garments, such as jackets and sweatshirts. Later, the CPSC’s Office of Compliance issued an announcement that such outerwear with drawstrings at the hood or neck would be regarded as both defective and a substantial risk of injury to young children.

Unfortunately, the CPSC guidelines are routinely ignored by the clothing industry, and that attitude has had deadly consequences for some children. The CPSC received reports of 22 deaths and 48 non-fatal entanglement incidents involving drawstrings on children’s clothing.

To date, no incidents or injuries have been reported in connection with this Product Recall.

The Defective Product is a children’s windbreaker jacket with drawstrings in the hoods. The jackets were sold in red, blue, and multi-colored (purple, blue, yellow, green, light blue) in sizes 12 months to 4T.

The Recalled Windbreakers, which were manufactured in China, were sold in department stores for about $80.00.

The CPSC is advising consumers to immediately remove the drawstrings from the jackets to eliminate the hazard.

Children Attacked by Bulldogs

Authorities say a pair of bulldogs attacked five children until the oldest fought off the dogs with a shovel.

The dogs were euthanized after Monday’s attack. Their owners face a fine of up to $1,000 or 90 days in jail.

The dogs attacked a 14-year-old boy, his three siblings, ages 9 to 12, and a 10-year-old relative.

Police believe the dogs broke out of their yard and approached the younger children, who were playing outside their nearby home. When the children ran inside, the dogs followed.

The 14-year-old boy was inside when the attack began and fought off the dogs with a shovel. He remains hospitalized but hopes to be home by Christmas. The other children have been treated and released from the hospital.

Elderly Women Suffers Dog Bite Injuries

According to the TV news, a woman tried to keep it from happening, she says she called the pound as recently as Saturday to warn animal control two of her neighbors dogs were loose.

“I’ve called the pound at least ten times,” she said.

The dogs escaped from their backyard on Thursday morning, attacking an elderly neighbor just before noon.

“It was a little more than your normal dog bite I guess” Director of Animal Services  said.

The woman tried to fight the dogs off with a gardening tool. She was on her own property when the attack happened.

“It’s awful,” she said about the thought of her neighbor being mauled by two dogs.

She said the dogs left a large laceration on her leg. The woman was treated at the hospital while the dogs were quarantined at the Animal Shelter.

There are reports of an average of 400 dog bites each year.
